01 Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the website at bigminds.online (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

The Site is operated by BigMinds, a trading name used by an independent sole operator based in Kenya (referred to as "BigMinds", "we", "us" or "our"). You can reach us at support@bigminds.online.

02 About the Site

BigMinds is a digital product studio. The Site is an informational presence that describes who we are and the products we build and operate. The Site itself does not sell products or provide a transactional service.

03 Our products are governed by their own terms

BigMinds builds and operates separate products, including e-soko.store and SmartLib (smartlib.cc). Those products are provided through their own websites and are governed by their own terms of service and privacy policies. These Terms apply only to the BigMinds Site and do not replace the terms of any individual product.

04 Acceptable use

When using the Site, you agree not to:

• use the Site for any unlawful purpose or in breach of any applicable law in Kenya or your jurisdiction;
• attempt to gain unauthorised access to the Site, its servers, or any connected systems;
• introduce malware, or otherwise interfere with the proper working of the Site;
• copy, scrape, or systematically extract content from the Site without our permission;
• misrepresent your affiliation with BigMinds or use our branding without authorisation.

05 Intellectual property

Unless stated otherwise, all content on the Site — including text, the BigMinds name and logo, layout, and design — is owned by or licensed to BigMinds and is protected by applicable intellectual property laws. You may view and share links to the Site, but you may not reproduce, distribute, or create derivative works from its content without our prior written consent.

06 Third-party links

The Site contains links to third-party websites, including our own products and external services. We are not responsible for the content, terms, or privacy practices of websites we do not control. Accessing third-party sites is at your own risk.

07 No warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. See our Disclaimer for more detail.

08 Limitation of liability

To the maximum extent permitted by law, BigMinds shall not be liable for any indirect, incidental, special, or consequential loss or damage, or any loss of data, profits, or goodwill, arising out of or in connection with your use of (or inability to use) the Site. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable Kenyan law.

09 Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we handle information in line with the Data Protection Act, 2019 (Kenya).

10 Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

11 Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Kenya. Where possible, we encourage you to contact us first so we can try to resolve the matter informally.
